Thanks for entrusting FluidWeb (“FluidWeb”, “we”, “us”, “our”) with your projects, your personal information or in the course of recruitment activities, when you access our website at https://fluidweb.io/ (hereinafter “the website”). Holding on to your private information is a serious responsibility, and we want you to know how we're handling it.

This Privacy Policy is an integral part of our “Terms of Use” and as long as you continue to use our Website and our services, you will be deemed to accept it.

Whose personal data do we process?

We can process your personal data if:
  • You are a client or vendor of FluidWeb (or are interested in becoming one);
  • You use products and/or services that have been developed by us;
  • You are a client (or work for a client), who we want to tell about and offer our services and/or products;
  • You are subcontractor, or are interested in working with us;

Whose data do we not process?

We deliberately do not request or collect personal data of children under 16 years of age and do not offer them our services. If we discover that a person under the age of 16 has given us their personal data without parental approval, we will take all necessary measures to delete this information.

Different countries may have different minimum age limits, and if you are below the minimum age for providing consent for data collection in your country, you can’t give as personal information.

What kind of personal information do we collect?

Business purposes

Recruitment purposes
We can process personal information that has been provided freely and directly by you.
  • Name;
  • Contact information, such as telephone number, and e-mail address;
  • Your fulfilled form information in section “Careers”;
  • Your CV/résumé (this will naturally include some private personal information, contact details and your employment background);
  • Any other information you voluntarily provide throughout the process, including online, through interviews or other forms of assessment;
  • If you are not successful, we may still keep your application to allow us to consider you for other suitable openings within FluidWeb in the future (if you disagree with aforementioned practice, please inform FluidWeb in writing accordingly).
Improving convenience

FluidWeb and partner third parties can automatically collect data using browser cookies in a depersonalized or aggregated form.

BY PROVIDING CONSENT TO THE PRIVACY POLICY AND TERMS OF USE, YOU WARRANT THAT YOU DO NOT PROVIDE US WITH SENSITIVE AND PROHIBITED INFORMATION.

How do we use this data?

We process your personal information for the following reasons, which include:
  • Records for individual contractors/entrepreneurs (as applicable): FluidWeb’s accounting and performance of contractual obligations, resourcing, team management, establishment of contractual relationship, performance of a contract, retention of candidate information.
  • Performance of services: software development, project delivery, management of the projects, support, provide with the paid service;
  • Operational support and maintenance: service request management, business continuity management, infrastructure support, system testing, improving and protection safety and our property or others.
  • Whistleblowing.
  • Background and compliance check.
  • To administer the contractual relationship between ourselves and our suppliers/clients in connection with the performance of a contract. If you are a representative of our current/potential client, vendor, partner we may process your personal data to develop and/or maintain business relations and communications, to promote our new products, works and services, to invite you to the meetings, events and organize them based on our legitimate interest.
  • Communication with you, only for the reasons you have said that is okay.
  • Complying with our legal obligations, protect our intellectual property, and enforce our Terms of Use.
  • Sharing in our website FluidWeb service portfolio as a collection of the overall set of services managed by the FluidWeb for our clients as well as client’s feedbacks (only after having freely given client’s consent).
  • Monitoring popularity of website. To provide relevant information on our website.

We limit our use of your personal information to the purposes listed in this Privacy Policy. If we need to use your personal Information for other purposes, we will ask your permission first.

Our legal bases for processing information

To the extent that our processing of your personal information is subject to certain international laws (including, but not limited to, the European Union's General Data Protection Regulation (GDPR)), FluidWeb is required to notify you about the legal basis on which we process personal Information.

With whom will we share your data?

  • Our auditors, legal consultants, and other professional consultants (in a limited way and only for fulfilling our obligations);
  • With the goal of completing any lawful obligations or for completing or abidance of any contract conditions, conditions of service provisions, or other agreements made with you in cases when we are required to disclose or share your personal data to achieve the goals stipulated in these agreements;
  • To protect the rights, property, and security of FluidWeb, our clients, our subcontractors, and other users. This includes sharing information with other companies and organizations (including law enforcement) with the goal of preventing fraud and other risks.
We do not sell your personal information for monetary or other consideration.

Please note: The California Consumer Privacy Act of 2018 (“CCPA”) requires businesses to state in their privacy policy whether or not they disclose personal information in exchange for monetary or other valuable consideration. While CCPA only covers California residents, we voluntarily extend its core rights for people to control their data to all of our users, not just those who live in California.

Usage of outbound links

FluidWeb websites might include links that lead to other websites, websites that are controlled by parties we are not related or connected to. After clicking an outbound link, we lose any control of collection, storage, or processing of your personal data that is transferred.

The behavior of third parties is also beyond the scope of our control, therefore FluidWeb is not responsible for the collection, storage, and processing of information, you share with third parties.

How long we process your personal data

We process personal data as long as it takes to achieve the goal (goals) for which this data was originally collected. Retention period of your data may vary based on options chosen in your consent form and current legislative requirements. Generally, FluidWeb does not store your personal data for a period longer than 6 years from the last contact with you, if you provide your consent for personal data processing. Contractual data may be stored by FluidWeb longer, if it required by law.

The personal data that is processed by FluidWeb.
If we receive personal data while we are providing services, we will take all necessary measures to guarantee:
  • Abidance to all necessary security measures that pervade over the data;
  • That your data is secure in accordance with this Privacy Policy.
  • We adhere to all commonly accepted industry standards for the protection of personal information that has been shared with us during the data transfer and the receipt of such data.

All processed personal information is stored on secure servers in Ukraine.

We seek to use reasonable organizational, technical, and administrative measures designed to protect personal information under our control.

Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you have with us has been compromised), please immediately notify us in accordance with the "CONTACTING US" section below.

Transmission of data on the FluidWeb is encrypted using SSH, HTTPS (TLS). We protect the data we have been trusted with and process them in accordance with this Policy. FluidWeb takes physical, administrative, and technological steps to ensure the security of this personal data from unsanctioned access, usage, and distribution according to the art. 32 GDPR.

Your responsibility

If a username and/or password is used to help protect your accounts and data, it is your responsibility to keep your information confidential and your internet connection secure. Do not share this information with anyone. If you share a computer with anyone, you should always log out.

For your own protection, we encourage you not to include sensitive personal data, credit card or similar personal data in any e-mails you send us or our team unless we specially request.
